14.3 and why Former President Trump Should be Disqualified from any Future Race or Ballot
Nothing is more fraudulent than allowing a known insurrectionist to run for public office, alone the highest office in the president.
Section 3 of the 14th Amendment of the Constitution mandates that anyone who swore an oath of office and then engaged in insurrection is forever barred from holding office again. Former President Donald Trump committed an insurrection on the Constitution when he conspired with fake electors to overthrow the peoples vote, pressured Pence to reject electors, and incited followers to the Capitol and stood by and did nothing as harm fell on officers at the Capitol. Trump is legally barred from the Ballot, and election officials must follow this constitutional mandate.
For every State in our nation, the power to prevent an insurrectionist from appearing on the Ballot lies with each State's Secretary of State or election officials.
In 2022, two states (Georgia and New Mexico) heard Section 3 challenges against those involved in the January 6, 2021 insurrection. Disqualification under Section Three of the 14th Amendment does not require any prior criminal conviction - for insurrection or otherwise. CREW won the first case removing someone from office for violating Section Three in 150 years. The case removed former Otero County Commissioner Couy Griffin, who had no prior criminal conviction for insurrection.
In December 2024, the Colorado Supreme Court disqualified Trump from the primary Ballot.
What does the Constitution say?
Section 3 of the Fourteenth Amendment to the U.S. Constitution: Disqualification from Holding Office
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability.
