Why the ERA Matters
Did you know it’s been over 100 years since the Equal Rights Amendment was drafted in 1923? This amendment would guarantee legal equality for all Americans, regardless of sex.
📜 The ERA states:
"Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex."
The U.S. prides itself on being a global leader, yet 76% of countries worldwide already have constitutional guarantees for equal rights. It’s time for us to catch up and ensure that equality for all becomes a reality.
Without this amendment, we will continue to face challenges like:
💔 Wage gaps and economic inequality
💔 Discrimination in housing, employment, and leadership
💔 Higher poverty risks for women and marginalized communities
The Next Steps
The ERA has already met the constitutional requirements to be published as the 28th Amendment. Now, it’s up to President Biden to right the wrongs of the previous Trump administration who did not publish it and instruct the archivist to publish it.
📌 Here’s why it’s time to act now:
✅ The Constitution doesn’t give Congress the power to set ratification deadlines.
✅ The ERA has overwhelming support—94% of Americans back gender equality. ✅ The United States lags behind the 76 percent of countries around the world with constitutions that guarantee equal rights for women.
✅ Legal experts, including 23 attorneys general and the American Bar Association, confirm the ERA is ready to be enshrined in law.
Earlier this week, Archivist Colleen Shogan issued a statement claiming she cannot publish the ERA. However, Senator Gillibrand has firmly rebutted this claim, pointing out critical facts:
The archivist’s role is purely ministerial—not a matter of policy or legal interpretation.
A legal counsel memo is not law, and Trump’s memo on this issue was entirely political.
Federal courts have clarified that prior cases were dismissed on grounds unrelated to ratification deadlines.
The Constitution does not grant Congress the authority to set deadlines for ratification.
Historical precedent proves this is possible—a previous archivist certified an amendment over 200 years old.
Legal experts, including 23 attorneys general and the American Bar Association, have confirmed the ERA is ready for publication.
Will the ERA face legal challenges in court? Absolutely. But that’s no reason to pause. Progress has never come without persistence, and it’s up to us to keep pushing the Equal Rights Amendment forward.

The People's March
We all march for different reasons, but we march for the same cause: to defend our rights and our future.
