Vox: The strange case that the Supreme Court keeps refusing to decide
Ian Millhiser writes about Hamm v. Smith, a case that the Supreme Court has met over two-dozen times to decide what to do with the case, inevitably putting off a decision for the future. The case centers Joseph Clifton Smith, “a man who says he is intellectually disabled,” and it “could open up all kinds of internal rifts among the justices” when interpreting the Eighth Amendment.

CNN: Supreme Court allows Biden EPA to enforce climate rules for power plants
Ella Nilsen and John Fritze report that on Wednesday the Supreme Court denied an emergency request by more than 20 Republican state attorneys general and industry groups and “allowed the Environmental Protection Agency to temporarily enforce its rules regulating planet-warming pollution from power plants.”

New York Times: Water Dispute Before Supreme Court Gives Rise to Unusual Alliances
Abbie VanSickle reports that on Wednesday during oral arguments, the Supreme Court “appeared to side with the City of San Francisco in its unusual challenge of federal water regulations that it said were too vague and could be interpreted too strictly.” This case could result in another blow to the EPA and its ability to curtail water pollution.

“The Supreme Court has become unhinged. There is no power like that of the people, and People Power United stands ready to protect our communities against any and all injustices,” said Laurie Woodward García of People Power United.
