Former Prosecutors Call Trump's Appeals Court Nominee' Worst Conceivable' Choice for Lifetime Judgeship

In a stunning rebuke of the judicial nomination process, former federal prosecutors and sitting Senators are sounding the alarm over Donald Trump's latest nominee to the U.S. Court of Appeals: Emil Bove. Described by his colleagues as "the worst conceivable nominee" for a lifetime appointment to the federal bench, Bove's record reads more like a cautionary tale than a résumé fit for one of the highest courts in the land. ¹

Born in 1981 and a graduate of Georgetown Law, Bove served as a prosecutor in the Southern District of New York (SDNY) from 2012 to 2021. He later became one of Trump's defense attorneys—including representing him in the Stormy Daniels hush-money case, where Trump was accused of deceiving voters during his presidential campaign—before ascending to a top post in the Department of Justice (DOJ). ²

From Mr. Bove’s time with the Southern District of New York, to his time representing Donald Trump, to his time at the Trump Justice Department, it’s been demonstrated that he will not let the law stand in the way of doing what he wants. That’s why, as soon as Mr. Bove joined the Justice Department in an acting, unconfirmed capacity, he began an effort to purge the Department of Justice of perceived, ‘enemies,’ like the January 6 prosecutors. - Senator Alex Padilla ³

In that DOJ role, Bove has come under serious ethical scrutiny. According to Senator Dick Durbin, "Text messages, email exchanges, and documents show that the Department of Justice misled a federal court and disregarded a court order. Mr. Bove spearheaded this effort, which demanded attorneys violate their ethical duty of candor to the court." ⁴ That isn't just unethical—it's potentially criminal conduct.

Perhaps most disturbing is Bove's role in a March 14, 2025 meeting, where whistleblower and former DOJ attorney Erez Reuveni alleges Bove said the department "would need to consider telling the courts' f** you' and ignore any such court order*" regarding deportation flights.⁵ This wasn't a flippant comment—he was proposing the DOJ defy the judiciary. It represents an outright assault on the rule of law.

But the scandals don't end there. Bove recently drew national outrage when he intervened to dismiss federal corruption charges against New York City Mayor Eric Adams. ⁶ Multiple career prosecutors resigned in protest, alleging the dismissal was a political favor tied to Adams' cooperation on immigration enforcement. ⁷

Even among defense attorneys, Bove's conduct has raised alarms. He has been described as "completely reckless and out of control" and even likened to "the prosecutor version of a drunk driver"—not the temperament expected of someone seeking a lifetime federal judgeship.⁸

In an extraordinary move, Bove's home-state Senators have formally opposed his nomination. This serious breach of the "blue slip" tradition usually gives home-state senators significant say in judicial nominations—that level of rejection signals just how controversial and dangerous this nomination truly is.

And yet, Bove's confirmation remains frighteningly close. The Senate Judiciary Committee is expected to vote soon—and Senator Thom Tillis is signaling that he plans to vote yes. ⁹ If every Republican backs him—as many are expected to out of loyalty to Trump—he could soon be handed the power to shape federal law for a generation.

This nomination is not about qualifications. It's a test of loyalty. Suppose a man who encouraged defying court orders and engaged in politically motivated cases is confirmed to the federal bench. In that case, it will mark a dangerous milestone in the collapse of judicial independence.

We cannot afford to remain silent.
