If anyone is telling you that Trump must be charged and convicted of insurrection before being disqualified, they are gaslighting you.
They may also be aiding in an insurrection on the Constitution by attempting to throw out our nation's founding charter.
Our laws come from the Constitution, Congress, and State Lawmakers. Courts use these three bodies to interpret and render decisions affecting our laws. It would be illegal to toss out the Constitution as it would be to toss out laws made by Congress or States.
Radical Republicans, crazed conservatives, and MAGA extremists are all attempting to ignore the Constitution and disrupt the rule of law by claiming that Trump must be charged and convicted of an insurrection to be disqualified under section 3 of the 14th Amendment. This behavior is dangerous to our rights and freedoms. In fact, the Constitution is touted as our fundamental law on the U.S. Courts website1 under the Rule of Law.
The U.S. Constitution is the nation's fundamental law. It codifies the core values of the people. Courts have the responsibility to interpret the Constitution's meaning, as well as the meaning of any laws passed by Congress. The Federalist # 78 states further that, if any law passed by Congress conflicts with the Constitution, "the Constitution ought to be preferred to the statute, the intention of the people to the intention of their agents.
What does the Constitution say?
“Section 3 of the Fourteenth Amendment to the U.S. Constitution: Disqualification from Holding Office2
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability.”
Furthermore, courts3 have found that Trump committed an insurrection, swore an oath to the Constitution, was an officer, and should be disqualified from appearing on the ballot as a presidential candidate.
Lastly, it is worth noting that several cases are being heard and challenged on different merits. Today, it was announced that the Michigan Supreme Court declined to rule on the 14.3 case4 and, by default, allowed Trump to remain on the primary ballot.
The court held that these challenges may not be filed before the primary–only afterward.
“The Michigan Supreme Court did not address any questions arising under the U.S. Constitution. It did not rule on Trump's claim that section 3 of the Fourteenth Amendment requires federal implementing legislation; it did not rule on Trump's claim that only Congress can decide presidential candidates' qualifications; it did not rule on Trump's claim that the president of the United States is not an "officer of the United States"; and it did not rule on any of various obscure legal theories raised by Trump's supporters. It simply declined to overrule a lower court ruling that the Michigan state challenge process does not allow challenges to presidential candidates at the primary stage. The court held that these challenges may not be filed before the primary–only afterward.” -Free Speech for People5
With that in mind, we are asking everyone to continue to be good stewards of democracy and advocate for our freedom to vote by reaching out to election administrators in your state to uphold the Constitution.
